<p>Child support laws exist to protect children and parents. Single parents who are victims or abuse or violence benefit greatly from these laws, as are single parents who have amicably divorced. These payments ensure that a child or children do not become disadvantaged due to the break up of their parents. Courts have the power to issue these orders and every state has their own law.</p>
<p>Without financial support, single parent families would struggle to survive. A court will decide what level of support is fair and appropriate for each situation and this may differ depending on a number of factors. Judges have flexibility in most states in terms of stating how much must be paid by the non-custodial parent. A judge&#8217;s decision is final but an appeal can be placed.</p>
<p>The parent who earns more generally has to contribute more to the well being of the child. If the non-custodial parent earns less than the custodial parent then they will generally have to pay less child support than if they earned more. The idea is to balance the finances so that the child or children have the best opportunity for a normal life after the parents have separated. It is not only income that is taken into account when determining the support amount, but also the assets of each parent such as the family home. The ultimate aim of the law is to ensure a certain standard of living for the child that would be possible if the parents were still together.</p>
<p>If the non-custodial parent is unable to pay child support then the court is able to temporarily suspend the payments until the circumstances change. <p>When an individual is seeking child support they are doing the right thing by making sure that their child will be cared for financially. While the cost of living has gone up, the economy has taken a downturn that has affected many individuals. The cost of raising a child can be expensive, especially if the responsibility falls on one person. Child support is an obligation that should not be seen as a punishment.</p>
<p>Usually, the parent who does not have primary custody of the child will be ordered to pay. The amount that they are ordered to pay will vary from state to state, but the amount to be paid is usually based on the parent&#8217;s income, the needs of the child, the parent&#8217;s ability to pay support and the amount of access the parent has to the child.</p>
<p>The court does however have the discretion to order additional support over and above the guideline child support if the child or children have special needs such as medical issues or special extracurricular activities. The court will also usually require that the parent ordered to pay to also provide medical insurance so that the health of the child will be maintained.</p>
<p>In some cases a trust or annuity can be set up in regards to the support obligation. This can happen if one parent has concerns about the other using the child support payment in the best interests of the child. The court can order that a portion of the payment be put in a trust or annuity if they feel that it is in the best interests of the child. In the instance of an annuity, the fund will be paid out on a fixed schedule over time and will guarantee a certain amount of income over that period of time. A trust is a fund that is also paid out over time, however, the court will appoint a trustee who will make payments at certain times or make payments as necessary for the health, education, maintenance and support of the child.</p>
<p>An order for support payments generally lasts until the child is 18 years of age and graduates from highs school. However, there are instances that can shorten or lengthen the period in which support must be paid. For instance if a child is disabled before their 18th birthday, the order to pay may extend into their adulthood. Additionally, if the child is of a certain age and self supporting or married the length of the child support order may be shortened.</p>
<p>Usually a wage withholding order is provided to the employer of the person ordered to pay support. Each pay period the ordered amount will be deducted from the parent&#8217;s salary amount and then disbursed by the respective states child support division.</p>
<p>Individuals who fail to pay the court ordered amount can be prosecuted and sent to jail. If an individual&#8217;s ability to pay for the needs of the child changes, they may request a modification to the original order. Filing for bankruptcy will not discharge an individual&#8217;s responsibility to pay child support.</p>

<p>Some parents who are ordered to pay child support often avoid their obligations. These parents are what we call dead beat parents. Most dead beat parents do not pay child support for reason just to spite the custodial parents. Some may be too lazy to get a job, others may be too selfish to dish out the money to pay for their responsibilities. Establishing paternity makes the non-custodial father legally obligated to the responsibilities of child support. If at anytime the alleged father doubts that the child is his, a genetic test would be performed to discover once and for all who the father is. Locating a missing parent can be difficult, especially if they live in another state. Sometimes tracking the social security number of the missing parent will help to pin point their location. Usually when the missing parent applies for a new job, their social security can be trace back to their location. <p>How do courts determine how much you pay in child support?<br />

<p>Alimony and child support will depend on which state you live in, how many children are involved and monthly income and expenses for both parties.</p>
<p>For tax purposes, child support is not income to the receiving parent and is not deductible to the parent paying it. Spousal support (alimony) is periodic support payments made to a spouse in divorce on a temporary or permanent basis.</p>
<p><em>Key Financial Issues: Child Support</em></p>
<p>In every state, there are formulas that determine the amount of child support it is necessary to pay. These formulas are called &#8220;guidelines.&#8221; Despite the mechanical nature of the calculations, there are points of flexibility.</p>
<p>Child support is not always simply the application of a formula. Here are some of the reasons:</p>
<p>1. At high levels of income, the guidelines typically do not apply. The level of income at which guidelines cease to apply varies from state to state.</p>
<p>2. There may be disagreements about what constitutes &#8220;income,&#8221; especially if a party is self-employed, or the income varies widely from year to year.</p>
<p>3. A spouse may be deliberately under-employed. Then a judge may &#8220;impute&#8221; income to that spouse.</p>
<p>4. In all cases, the parties may negotiate a child support different than the guideline amounts. A judge will generally approve the negotiated outcome unless it is clearly unfair to one party.</p>
<p><em>Key Financial Issues: Alimony </em></p>
<p>Unlike child support, which has a significant state involvement, alimony is almost always purely the result of the negotiation between the parties. In a few states, there are alimony formulas. But even there, the alimony calculated is usually intended to be only temporary.</p>
<p>Different states have different attitudes to alimony. Some states are inclined to award lifetime alimony after ten-year marriages in which the recipient stayed home and supported the family. Other states are not inclined to award any alimony at all, or will award alimony of only a few years. It is intended to allow the recipient to train for a career (often called &#8220;rehabilitative&#8221; alimony).</p>

<p>Parents should keep in mind that child support laws are meant to benefit the child(ren), not the custodial parent.</p>
<p>Divorce  separation or the break-up of a relationship can cause havoc in the  family structure, especially for children. Unfortunately, oftentimes  parents become so angry with the other parent, they forget about the  children. A parent&#8217;s anger can become so intense that they completely  disregard the welfare of their child(ren) and focus solely on &#8220;getting  back&#8221; at the other parent. The first strategy of revenge is money. By  withholding money, the other parent uses it as leverage to control the  custodial parent. Here is where the child support court can be  beneficial through child support enforcement.</p>
<p>While some parents  feel the need to blame the ex-spouse, the judge, or the court system in  general when a parent exercises his or her child support rights or their  child custody rights, the reality is that there&#8217;s no one to blame. On  the contrary, parents should praise the court system for stepping up and  protecting the child(ren) who are completely innocent because without a  proper child support order many children would suffer.</p>
<p>True  enough, there may be instances when perhaps a support order seems  unfair, however, parents must keep in mind that they and the other  parent are both responsible for supporting their children if they are  under age 18. And this duty may extend beyond age 18 if certain  conditions are met.</p>
<p>The amount of support to be paid by one parent  to the other is based on established guidelines. Computer programs are  available for helping parents determine who will pay such support, and  how much is to be paid. Custodial time share is a big determinant. In  other words, how much money one parent is ordered to pay to the other  for child support is largely based on how much time each parent spends  with the child(ren). The more time spent, the less money paid. Another  factor is each parent&#8217;s income, as well as the lifestyle the child may  have become accustomed to.</p>
<p>The one thing a parent who has been  order to pay support for the child should avoid is to accumulate support  arrears (back-pay) by not paying ordered support. This creates a  slippery slope of debt and legal violations. Laws are becoming much  stricter than in times past. Parent who owe child support arrears may  have their driver&#8217;s license suspended or their income tax return  intercepted, among other ways of penalizing the non-paying parent.</p>
<p>If  necessary, a custodial parent may request a wage assignment order. This  is an order that requires the other parent&#8217;s employer to make child  support payments directly to the parent entitled to receive support.</p>
<p>So,  in the end, the real benefit is to the child(ren). If for any (valid)  reason a paying parent truly believes that child support that they are  paying to a custodial parent is not being properly utilized for the  child(ren) the paying parent should gather as much supporting evidence  to show the mishandling of funds and present it at a family court  hearing. Refusing to pay child support is not the answer; this approach  will only cause trouble. Pay the money and address any problems with the  court. Remember, it&#8217;s for the kids!</p>

<p>Parents who pay child support are often concerned that the money be actually used for the needs of the children, rather than their ex-spouse.</p>
<p>Child support is designed to cover the necessities, such as food, clothing, shelter, basic medical care, etc. In addition to a base amount of support, the parents may also be expected to pay additional amounts for extraordinary medical care, private schools, sports and other activities, and so on. In some states, the parents can be ordered to pay for all or part of college costs, as well.</p>
<p>So what if the receiving parent spends the money on themselves, rather than the children?</p>
<p>Usually, it doesn&#8217;t matter. As long as the children are not being neglected, the receiving parent does not have to account for how they spend the money. Some costs, such as the rent or mortgage, utilities, groceries, etc. are partially for the children and partially for the parent. It wouldn&#8217;t be reasonable to ask a parent to account for every dime when so many of these &#8220;mixed costs&#8221; are involved.</p>
<p>Sometimes, the paying parent decides to give the money directly to their children, especially if the children are teenagers and need money for gas and entertainment. Their reasoning is that at least they know the kids are getting the money.</p>
<p>While you are free to give your children whatever you like, realize that paying them directly does not reduce your obligation to pay your ex-spouse. Remember, he or she is paying the rent and buying the groceries.</p>
<p>The best course of action is to pay your spouse the amount you owe, and think of that money as being used for the children&#8217;s expenses and for basic household expenses. Assume any &#8220;pampering&#8221; or luxuries your ex-spouse is getting are being paid for from their own money. Whether or not this is true, believing it will benefit your attitude and mental state immensely.</p>
