The California Vehicle Code states that it is unlawful for a person to ride a bicycle on a highway while under the influence of alcohol or any drug.

As with a motorized vehicle, a first time DUI offense is typically filed as a misdemeanor. The penalties can include fines and mandatory community service. If convicted, a bicycle DUI in California will remain on a person’s Department of Motor Vehicles driving record for three years.

FDLE Says Actions Could Impact Numerous Florida Drunk Driving Cases /maricopa-county-courts/maricopa-criminal-court/dui-arizona/arizona-dui-laws/fdle-says-actions-could-impact-numerous-florida-drunk-driving-cases/ /maricopa-county-courts/maricopa-criminal-court/dui-arizona/arizona-dui-laws/fdle-says-actions-could-impact-numerous-florida-drunk-driving-cases/#comments Wed, 22 Oct 2008 15:06:38 +0000 duinick The Florida Department of Law Enforcement has announced the firing of a DUI inspector who deliberately turned off breath testing equipment when they looked like they were going to fail required inspections. Sandra Viega serviced machines in South Florida and her actions threaten the outcome of numerous cases of driving under the influence in Broward, Miami-Dade and Monroe counties.

Viega acknowledged to Miami Beach and Miami-Dade police departments that she intentionally turned off the power to Breathalyzer machines when it appeared they would fail required calibration tests. She said that by pulling the plug on the equipment there would be no documentation of the attempted test. Under Florida law, such testing must be undertaken monthly by local law enforcement agencies and annually by the FDLE in order to ensure that the machines are properly calibrated.

If the tests are interrupted or altered, the accuracy of the breath testing equipment can be questioned. In response, South Florida DUI defense attorneys are challenging drunk driving cases, saying the lack of proper maintenance may have lead to false BAC readings and erroneous arrests when their clients were actually not legally intoxicated.

The FDLE issued a notice to law enforcement agencies in three south Florida counties last July, telling them to alert prosecutors handling DUI cases that breath sample evidence was compromised. Prosecutors, in turn, were responsible for informing defense attorneys whose cases may have been affected.

Until the agreement, motorists suspected of driving while intoxicated would flee to the reservation because they knew state authorities had no jurisdiction.

There are now reports that New Mexico DUI cases appearing in front of one Navajo Nation judge are being dismissed when the arrest was conducted by a non-Native American. Specifically he challenges the concept of non-Native American law enforcement officers arresting Native Americans on tribal land.

The McKinley County District Attorney could not confirm or deny the allegations.

Wood had played in the team’s win over Vanderbilt Saturday afternoon.

Wood said he was picking up his girlfriend and her friends from downtown Athens. He left his parking lights on while waiting and forgot to turn on his headlights during the drive back to east campus. After being stopped for driving while lights are required by campus police around 3:40 am Sunday morning, Wood was charged with driving under the influence in Georgia.

Head coach Mark Richt said that Wood, while 21 and of legal age to drink, made a “bad error in judgment”. The Georgia Athletic Association policy says that an athlete who commits a first-offense violation of alcohol rules will be suspended for 10% of the season. Wood, a red-shirt sophomore who has played in all seven of Georgia’s games this year, will not be playing in the upcoming game against LSU.

Guns and Ammo Found in Illinois DUI Arrestees Mini Van /maricopa-county-courts/maricopa-criminal-court/dui-arizona/arizona-dui-laws/guns-and-ammo-found-in-illinois-dui-arrestees-mini-van/ /maricopa-county-courts/maricopa-criminal-court/dui-arizona/arizona-dui-laws/guns-and-ammo-found-in-illinois-dui-arrestees-mini-van/#comments Tue, 21 Oct 2008 18:08:15 +0000 duinick Police found a cache of weapons and ammunition after a drunken motorist was pulled over for a traffic crash in the Rogers Park neighborhood Monday night.

John Buciuman, 42, of the 6000 block of North Ridge Avenue, was charged with six felony counts of aggravated unauthorized use of a weapon, six counts of non-registration of firearms, six counts of possessing firearms without valid FOID card and possession of ammunition without valid FOID card, according to a police News Affairs release.

While Buciuman’s minivan was being moved out of the street, a gym bag that was slightly opened and contained ammunition and firearm magazines was found in plain view. Also found was a cache of numerous weapons and ammunitions throughout the minivan, the release said. The inventory included 4 rifles (3 of which are assault rifles), a 12-gauge shotgun, a .380 caliber revolver and over 50 pounds of various bulk ammunition, the release said.

Buciuman is expected to appear later Tuesday for a bond hearing in North Felony Court, (Br. 42) at 2452 W. Belmont Ave. according to the release, which said he is also expected to appear in court on Oct. 30.

About 7 p.m., a Rogers Park District beat officer was dispatched to an auto accident in the 1900 block of West Granville Avenue. The officer saw Buciuman’s 2005 Dodge Caravan had apparently rear-ended another vehicle and was creating a hazard on Granville Avenue. Buciuman appeared to be confused while speaking to the officer and the officer believed he had an odor of alcohol on his breath, the release said.

A sergeant on the scene also immediately recognized Buciuman as having been arrested.

A Hillsborough circuit judge didn’t believe 23-year-old Natalie Rodriques when she said at a hearing Monday that she didn’t know she had hit anyone. Authorities say Rodriques was driving with a blood alcohol level of 0.13% in March 2007 when she hit 16-year-old Irvin Eppy Soto Jr. Rodriques drove nearly a mile before crashing her pickup into a ditch. Records show she also had traces of cocaine, marijuana and Xanax in her system.

Records show Rodriques had already been arrested for driving under the influence two months earlier.

Rodriques will face 10 years of probation after being released from prison. Also, she can never again drive in Florida.

Jessica R. Kopacz, 30, of Logan was arrested Friday on a charge of driving under the influence following a single-vehicle accident.

Benton police officers were dispatched to the 600 block of South McLeansboro Street at 6:30 p.m. after witnesses reported that a vehicle was in the ditch.

Witnesses said the driver had walked away from the scene, and Kopacz was contacted a short distance away.

Benton Police Chief Mike O’Neill said Kopacz performed field sobriety tests and then was transported to the Franklin County Jail following her arrest.

On Saturday, Michael A. Williams, 45, of Benton was charged with driving under the influence, failure to reduce speed to avoid an accident and illegal transportation of alcohol following a single-vehicle accident that occurred at 1:15 a.m.

O’Neill said an officer observed a vehicle on North Main Street that was partially sitting on the roadway and the sidewalk. He said Williams was walking around the vehicle, and the officer determined that the vehicle had been involved in an accident at the intersection of North Main and Mitchell streets.

Williams displayed minor injuries but refused medical treatment. He was transported to the Franklin County Jail and left with correctional staff following his arrest. His vehicle was towed from the scene.

A judge sentenced 52-year-old William Conner to 2-and-a-half to 5 years behind bars. Police found him passed out, slumped over the steering wheel of his pickup truck, stuck in a snow bank last January. His car was still running and police say his blood alcohol level was 3 times the legal limit.

He also didn’t have a valid driver’s license.

Apparently the 3 strikes your out rule is no more. I guess they figured tripling it would be fair. WHAT A JOKE!!!

Vick, 24, the brother of former football player Michael Vick, also was convicted of eluding a police officer and driving on the wrong side of the road, according to Commonwealth’s Attorney’s spokeswoman Amanda Howie. Vick was charged in June after fleeing from a bicycle officer.

A judge suspended a 12-month jail sentence on the drunken driving charge, Howie said, and imposed a fine of $250 and suspended Vick’s license for a year. Vick must also pay $280 in fines on the other charges.

Vick played football at Virginia Tech but was dropped from the team in 2006 after a series of problems on the field and elsewhere. He was released by the Miami Dolphins in 2007.

Wow, both these brothers had a great opportunity at a great life and both messed it up 10 fold. What a shame.

“I want to apologize to the New York Yankees and the fans for an error in judgment and for putting myself in a difficult situation,” said Chamberlain in a statement released by his agent, Randy Hendricks. “I intend to properly resolve this situation, and do not intend to be in such a situation again. My goal is to focus on pitching for the Yankees in the 2009 season.”

Chamberlain was arrested early Saturday just outside his hometown of Lincoln, Nebraska. According to the Lincoln Journal Star, Chamberlain was pulled over for speeding by the Nebraska State Patrol just after 1 a.m. The officer detected an odor of alcohol coming from the car and saw an open container of alcohol in the vehicle.

Chamberlain, 23, just completed his second season in the majors with the Yankees, compiling a 4-3 record with a 2.60 earned run average in 42 games, including 12 starts. The righty has been used as both a set-up man and a starter, and team chairman Hank Steinbrenner said recently that the team would probably use him as a starter in 2009.
